Terms & Conditions

1. Agreement to Terms

By accessing or using the website usasupertech.com ("Site") or engaging USA SuperTech ("we," "us," "our") for IT services, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our Site or services.

2. Services

USA SuperTech provides managed IT services, cybersecurity solutions, network design and deployment, computer and device repair, on-site installations, and cloud and backup solutions for residential and commercial clients. The specific scope, deliverables, and pricing of any service engagement will be defined in a separate service agreement or statement of work.

3. Service Agreements

Managed IT plans and recurring services are governed by individual service agreements that outline scope, pricing, service level agreements (SLAs), and cancellation terms. These Terms and Conditions apply in addition to any specific service agreement. In the event of a conflict, the specific service agreement will take precedence.

4. Pricing and Payment

  • Managed IT plans are billed monthly per user as outlined on our pricing page and in your service agreement.
  • Device add-ons are billed monthly per device.
  • On-demand services (break-fix, installations, projects) are billed at our published hourly rates with applicable minimums.
  • Materials, parts, and third-party licenses are billed separately at cost plus a reasonable markup.
  • Payment is due upon receipt of invoice unless otherwise specified. We accept credit/debit cards processed through Stripe.
  • Late payments may incur a fee of 1.5% per month on the outstanding balance.

5. Cancellation and Refunds

Managed IT plans operate on a month-to-month basis unless otherwise specified. You may cancel with 30 days' written notice. No refunds are provided for partial months of service. On-demand services are non-refundable once work has been performed.

6. Client Responsibilities

To enable us to provide effective service, you agree to:

  • Provide timely and accurate information about your IT environment
  • Grant reasonable access to systems, networks, and facilities as needed
  • Maintain current backups of critical data (unless backup services are included in your plan)
  • Promptly communicate any issues, changes, or security concerns
  • Comply with all software licensing requirements for products used in your environment

7. Limitation of Liability

To the maximum extent permitted by law, USA SuperTech shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, revenue, profits, or business opportunities, arising from or related to our services. Our total liability for any claim shall not exceed the fees paid by you for the specific service giving rise to the claim during the three (3) months preceding the incident.

8. Data and Confidentiality

We treat all client data and system information as confidential. We will not disclose your information to third parties except as required to deliver services (e.g., coordinating with your software vendors) or as required by law. Our handling of personal information is further described in our Privacy Policy.

9. No Guarantee of Results

While we strive to resolve all technical issues and provide reliable IT solutions, we cannot guarantee specific outcomes, uninterrupted service, or that every issue will be resolved. Technology involves inherent risks, and certain problems may be caused by factors outside our control (e.g., hardware failure, third-party software bugs, internet service provider outages).

10. Intellectual Property

All content on this website — including text, graphics, logos, images, and code — is the property of USA SuperTech and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works from our content without prior written consent.

11. Affiliate Links

Our services may involve the use of third-party software, platforms, and tools (e.g., Microsoft 365, Google Workspace, Synology, Ubiquiti). We are not responsible for the terms, pricing changes, outages, or policies of third-party providers. Your use of such platforms is governed by their respective terms of service.

13. Indemnification

You agree to indemnify and hold harmless USA SuperTech, its owners, employees, and contractors from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of our services, violation of these terms, or infringement of any third-party rights.

14. Governing Law

These Terms and Conditions are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes arising under these terms shall be resolved in the courts of Palm Beach County, Florida.

15. Modifications

We reserve the right to update these Terms and Conditions at any time. Changes will be posted on this page with an updated date. Continued use of our Site or services after changes are posted constitutes your acceptance of the revised terms.
